Hart said he returned fire using a handgun that another partygoer handed to him as he left the party. Hart has said Mitchell fired first, but the slain mans girlfriend, Ayanna Hughley, said that Hart fired the first shot.Judge Hughes wrote in the order that even if Hart was carrying the weapon legally and wasnt required to back away from the situation, he hasnt met the burden of proof to establish immunity based on a review of the evidence.Were disappointed with the ruling, Harts attorney Jerry Blevins said Tuesday.
